Japanese Knotweed

It’s a longstanding item of the due diligence process but it looks like owners of property affected by the dreaded Japanese knotweed could also be liable for damages to neighbouring properties if the knotweed spreads – which it seems to be apt to do.  Network Rail lost a case  last month where adjoining owners had claimed compensation for failure to treat the problem.   There was a piece in the Observer today   outlining some problems that owners are having selling their homes (knotweed free) because of problems buyers are having in obtaining mortgages.   Basically it’s because they don’t seem to be able to get sufficient information on the actions that are being taken by Network Rail.
